END USER LICENSE AGREEMENT (EULA) AND DISCLAIMER

IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY BEFORE INSTALLING OR USING ANY SOFTWARE

This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and the developer for any software products, applications, tools, or utilities ("Software Products" or individually "Software") developed and distributed by me. By installing, copying, downloading, accessing, or otherwise using any Software, you agree to be bound by the terms of this Agreement.

PART I: LICENSE TERMS

1. Scope of Agreement

1.1 Covered Products
This Agreement applies to all software products developed and distributed by me, including but not limited to:
- Desktop applications and utilities
- Mobile applications and tools
- Web-based software and services
- Command-line tools and libraries
- Development tools and debugging utilities
- Communication and networking software
- Data processing and analysis tools
- Any future software products released by me

1.2 Product-Specific Terms
Individual Software Products may have additional terms or restrictions specified in:
- Product documentation or README files
- Installation notes or setup guides
- Release notes or changelogs
- Product-specific license files
- Online service terms or API documentation

Such additional terms supplement but do not replace this Agreement. In case of conflict, product-specific terms take precedence for that particular Software.

2. Grant of License

2.1 Free Version License
Subject to the terms of this Agreement, I grant you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use my free Software Products on a reasonable number of devices for personal, educational, or evaluation purposes
- Make backup copies for archival purposes only
- Use the Software Products for non-commercial debugging, development, testing, and personal activities
- Access and use free features and functionalities as made available

2.2 Paid Version License
Upon payment of applicable license fees for specific Software Products, I grant you additional rights to:
- Use the paid Software Products for commercial purposes as specified in your purchase agreement
- Access premium features and functionality of the purchased Software
- Receive basic technical support as I am able to provide
- Use the Software Products in accordance with the specific license type purchased

2.3 Universal License Restrictions
Regardless of the specific Software Product, you may NOT:
- Reverse engineer, decompile, or disassemble any Software
- Remove or alter any copyright, trademark, or other proprietary notices
- Distribute, rent, lease, sublicense, or transfer any Software to third parties without authorization
- Use any Software to develop directly competing products
- Use any Software in violation of applicable laws or regulations
- Circumvent any technical limitations or security measures in the Software
- Use any Software for illegal, harmful, or malicious purposes
- Claim ownership of any Software or present it as your own work

3. Intellectual Property Rights

3.1 Ownership
All Software Products and the intellectual property rights therein are and shall remain my exclusive property. This Agreement does not transfer any ownership rights to you.

3.2 Third-Party Components
My Software Products may include third-party open-source components, libraries, or frameworks, each governed by its respective license terms. You agree to comply with all applicable third-party license requirements.

3.3 Attribution
For open-source or attribution-required Software, you must maintain all copyright notices and attribution requirements as specified in the Software documentation.

4. License Types and Fees

4.1 Free Versions
- No license fee required
- May have limited functionality compared to paid versions
- No guarantee of technical support (provided on best-effort basis)
- May include donation requests or sponsor acknowledgments
- Intended for personal, educational, or evaluation use
- Commercial use restrictions may apply

4.2 Paid Versions (if applicable)
- Personal or commercial use as specified
- Enhanced features or functionality
- Basic support via email (best effort, no guarantees)
- License fees vary by Software Product
- Payment processed through third-party platforms

4.3 Donation-Supported Software
- Some Software may be free but accept voluntary donations
- Donations do not create additional obligations or warranties
- Donors may receive acknowledgment but no special privileges
- Donations help support continued development

5. Updates and Maintenance

5.1 Free Software Updates
- Updates provided at my sole discretion and availability
- No guarantee of continued updates or maintenance
- Development may be discontinued without notice
- Bug fixes and security updates provided when possible

5.2 Paid Software Updates
- Updates may be provided during reasonable support periods
- Major version upgrades may require additional fees
- Update frequency depends on development time availability
- No guaranteed timeline for updates or new features

5.3 Community Contributions
- Bug reports and feature suggestions are welcome
- No obligation to implement suggested features
- Community patches may be accepted at my discretion
- Contributors may receive acknowledgment

6. Term and Termination

6.1 License Term
- Free licenses: Perpetual until terminated
- Paid licenses: As specified in purchase terms
- Trial licenses: For specified evaluation periods only

6.2 Termination Conditions
This Agreement and any specific Software license terminates automatically if you:
- Breach any terms of this Agreement
- Fail to pay required license fees for paid Software
- Use any Software for prohibited purposes
- Violate intellectual property rights
- Distribute malicious modifications of the Software

6.3 Effect of Termination
Upon termination, you must immediately cease using all affected Software and destroy all copies in your possession.

PART II: DISCLAIMER AND LIMITATION OF LIABILITY

7. Disclaimer of Warranties

7.1 "AS IS" Provision
ALL SOFTWARE PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 No Warranties
As an individual developer, I make no representations or warranties about any Software Product regarding:
- Accuracy, reliability, or completeness
- Fitness for any particular purpose or use case
- Meeting your specific requirements or expectations
- Uninterrupted or error-free operation
- Correction of defects or issues
- Availability of updates, support, or maintenance
- Compatibility with your hardware, software, or systems
- Data integrity or security

7.3 Individual Developer Limitations
Please understand that as an individual developer:
- I have limited resources and time for support and maintenance
- Software is developed in my spare time or as a side project
- Professional-grade support cannot be guaranteed
- Development priorities may change based on personal circumstances
- Some projects may be discontinued if I cannot maintain them

8. Limitation of Liability

8.1 Damages Limitation
IN NO EVENT SHALL I BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT ARISING IN ANY WAY OUT OF THE USE OF ANY SOFTWARE PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

8.2 Maximum Liability Cap
My total liability for all claims related to any Software Product shall not exceed the amount paid by you for that specific Software Product, if any. For free Software, my liability is limited to zero.

8.3 Individual Developer Protection
As an individual developer without corporate backing:
- I cannot provide the same level of liability protection as large companies
- My personal assets must be protected from software-related claims
- Users assume greater responsibility when using individual-developed software
- Commercial users should implement additional safeguards and insurance

9. Hardware, Data, and System Risks

9.1 Equipment and Hardware Safety
- You assume full responsibility for any damage to connected hardware devices, systems, or equipment
- Test Software thoroughly in non-critical environments before production use
- Implement proper backup and safety measures
- I cannot be held responsible for hardware compatibility issues or equipment damage

9.2 Data Security and Privacy
- All data processed by any Software Product is your sole responsibility
- Implement appropriate backup, security, and access control measures
- I do not guarantee data security or privacy protection
- Critical data should be backed up before using any Software
- Compliance with data protection laws is your responsibility

9.3 System Integration
- Test Software compatibility with your systems before deployment
- Performance impact on existing systems is possible
- Integration issues may occur with different configurations
- Professional testing recommended for business-critical applications

10. Regulatory and Legal Compliance

10.1 User Responsibility
You are solely responsible for ensuring that your use of any Software Product complies with:
- All applicable local, national, and international laws
- Industry-specific standards and requirements
- Data protection and privacy regulations
- Professional licensing requirements
- Corporate policies and security standards
- Import/export control regulations

10.2 Geographic Restrictions
- Some Software may not be suitable for use in certain jurisdictions
- You are responsible for determining legal compliance in your location
- Export restrictions may apply to certain Software

11. Prohibited Uses

11.1 Critical Applications
NO SOFTWARE PRODUCT SHALL BE USED IN:
- Life-critical or safety-critical systems
- Medical devices or healthcare applications
- Nuclear, aerospace, or defense systems
- Emergency response or communication systems
- Financial trading or banking systems
- Transportation control systems
- Industrial control systems managing hazardous processes
- Any application where failure could result in death, injury, or significant damage

11.2 Illegal or Harmful Activities
Software Products may not be used for:
- Any illegal, fraudulent, or criminal activities
- Harassment, stalking, or threatening others
- Distributing malware or malicious code
- Unauthorized access to systems or networks
- Copyright or trademark infringement
- Privacy violations or unauthorized data collection
- Activities that could harm others or my reputation

11.3 Competitive Restrictions
You may not:
- Use my Software to develop directly competing products for commercial sale
- Extract or copy proprietary algorithms for competitive purposes
- Reverse engineer Software to create competing solutions
- Remove attribution or present my work as your own

PART III: GENERAL PROVISIONS

12. Support and Services

12.1 Free Software Support
- No guarantee of technical support for free Software
- Support provided on a voluntary, best-effort basis when time permits
- Community forums or documentation may be available
- Response times cannot be guaranteed
- Complex issues may not be resolvable due to time constraints

12.2 Paid Software Support (if applicable)
- Basic support may be provided for paid Software
- Support typically via email during reasonable hours
- Response time varies based on availability and issue complexity
- No guarantee of issue resolution due to individual developer limitations
- Support may be discontinued if I cannot maintain the Software

12.3 Community Support
- User communities may provide peer-to-peer support
- Community contributions and solutions are encouraged
- I am not responsible for community-provided information or assistance
- Official support takes precedence over community advice

13. Privacy and Data Collection

13.1 Data Collection (if any)
Some Software Products may collect limited information such as:
- Basic usage statistics for improvement purposes
- Error reports to help fix bugs
- Anonymous feature usage data
- License validation information

13.2 Data Usage
Any collected information is used solely for:
- Software improvement and debugging
- Understanding feature usage patterns
- Technical support purposes
- No personal data is shared with third parties

13.3 Privacy Rights
- Detailed privacy practices are described in individual Software documentation
- Data collection can typically be disabled in Software settings
- Minimal data collection principle is followed
- No advertising or marketing use of collected data

14. Updates to Agreement

14.1 Modification Rights
I reserve the right to modify this Agreement to:
- Reflect changes in Software Products or development practices
- Address new legal requirements or recommendations
- Improve clarity or fix issues in the agreement
- Add terms for new features or capabilities

14.2 Notification of Changes
- Significant changes will be announced through appropriate channels
- Updated Agreement will be posted with new Software releases
- Continued use after changes constitutes acceptance
- Major changes may be highlighted in release notes

15. Development and Availability

15.1 Individual Developer Constraints
Please understand that as an individual developer:
- Development time is limited and depends on personal availability
- Projects may be discontinued if I cannot maintain them
- Feature requests may not be implemented due to time or resource constraints
- Professional obligations or personal circumstances may affect development

15.2 No Guarantees
- No guarantee of continued development or maintenance
- No promise of specific features or timelines
- Software may become obsolete or incompatible over time
- Migration assistance may not be available if Software is discontinued

15.3 Open Source Consideration
- Some Software may be released as open source to ensure continuity
- Community maintenance may be possible for discontinued projects
- Source code availability depends on individual project decisions

16. Geographic and Legal Provisions

16.1 Governing Law
This Agreement is governed by the laws of [Your Country/State], without regard to conflict of law principles.

16.2 Dispute Resolution
- Disputes should first be addressed through direct communication
- Legal action, if necessary, shall be in the courts of [Your Jurisdiction]

This agreement is provided in both English and Chinese for convenience. In case of any discrepancy between the two versions, the English version shall prevail.
